Nomad & Nest has created this Site in order to give our Customer (“you”) an online service.  This is a legal document and Agreement which sets out our Terms and Conditions (“Terms”). By using our Site or by placing an order you agree to enter into a Contract and to comply with and be bound by our Terms in this Agreement. We may revise our Terms at any time and you should review the Terms of this Agreement regularly for any changes made. This Contract shall be concluded in English (U.K).

We also reserve the right to change or update any information what so ever and without prior notice. This includes after you have submitted your order.

PRODUCT INFORMATION
We reserve the right to alter, modify or update any of our Products at any time without prior notice.  This includes design details, features, materials, dimensions and sizes, colours, product descriptions, product photographs on the Site or present in any Nomad & Nest literature or promotional material, care instructions and prices and any other relavant aspects associated with the Product.

Definitions
These are some of our definitions of Products that we refer to on our Site:
Handmade – Items individually crafted and made by hand.
Made to Order – Standard Upholstery or other items individually made to a Customers  specification.
Bespoke – Commissioned, designed, made and created to a Customers specification.
Customised – Standard products tailored, decorated, embelished and/or transformed.
Vintage – Items over twenty years old and which are often second-hand.

Materials, Textures and Colours
We endeavour to display our products as accurately as possible. However, due to the handmade nature of the Nomad & Nest products and the selection of materials which include natural scars, marks and blemishes in leather as well as variations in colour and texture, composition, the Nomad & Nest Product photographs displayed on the Nomad & Nest site will vary from the product received. These variations and intrinsic scars, marks and blemishes are not deemed as defects but introduced as intentional design features to create unique character in all Nomad & Nest Products. Our Products are made from materials that are natural or dyed, coloured or woven and may vary in a batch at any time. Some materials are recycled, re-used and re-furbished and therefore display imperfections which are deemed features and not defects.  Some of the Products will have worn qualities mainly found on Vintage, Second-hand or Recycled Products which are also deemed features and not defects. All Nomad & Nest product photographs illustrate a typical example of the Product and product colour.  We have made every effort to photograph, reproduce and display our Products as accurately as possible. However, we cannot guarantee that your monitor’s display of any of the colours of the Nomad & Nest Products will be accurate and thereby we cannot guarantee your Nomad & Nest Product when delivered will replicate the item viewed on screen at the time of purchase.

Sizes and Dimensions
All sizes and measurements concerning Nomad & Nest Products are as accurate as possible but due to the handmade nature of many of our products dimensions will vary.

ORDERING
We reserve the right to withdraw any Products from this Site at any time and/or remove or edit any materials or content on this Site.

Order Acceptance
Nomad & Nest reserves the right to decline to fulfill orders for any reason or refuse service to anyone at any time and at our sole discretion. This includes withdrawing a Nomad & Nest Product which has been mis-published, such as its price or specification.  Orders received by Nomad & Nest are treated as offers which we are entitled to accept or decline. 

Order acceptance and the completion of the Agreement between you and Nomad & Nest will come in to effect at the point of dispatch of your ordered Products to you, unless we have notified you that we do not accept your order, or we have received your order cancellation in accordance with our Terms. Non-acceptance of your order may be a result of one of the following:

1. The Product you ordered being out of stock.
2. We have identified an error in pricing or Product description.
3. Unsuccessful attempts to obtain authorisation for your payment.
4. Your failure to meet the eligibility to order criteria set out in the main Terms and Conditions.

If there are any problems with your order, we will contact you as soon as possible.

Order Quantities
We reserve the right to decline to fulfil orders of more than 5 Products at any time.  Orders fulfilled will be subject to payment authorisation and at our discretion.  Sale items are restricted to 2 of the same Nomad & Nest Product per customer.

DELIVERY
There is only one delivery charge per order regardless of size of order.

Orders will be dispatched using a ‘signed for’ or ‘tracking service’ and you will need to sign for your delivery.

Our delivery costs are:

All UK orders are dispatched to the delivery address only. We are unable to fulfil requests to leave deliveries with a neighbour or similar requests. For overseas orders we only deliver to your billing address. All deliveries must be signed-for at the delivery address you provide to us as part of your order. Note that we cannot be responsible for orders which go missing after delivery.
Customers sending cheque payments may encounter a delay in their order being dispatched, as all cheque payments will need to be cleared prior to dispatch.

Nomad & Nest does not accept any liability whatsoever for delays in the delivery caused by any third party. At the point you receive the Nomad & Nest Products you will assume all risk in the Products supplied.

Stock lead times
Nomad & Nest Products are not produced in high volumes and are therefore subject to availability. 

Products in Stock –
U.K delivery -  within 2 - 5 working days
International delivery -  14 working days (subject to final destination, country and Customs clearance where Nomad & Nest will not be responsible for any delays whatsoever).

When Products ordered are in stock we aim to dispatch and deliver Nomad & Nest Products (excluding our ‘Made to Order Upholstery’ Products) on receipt of your order; however this is not guaranteed. We recommend placing your orders early at particularly busy times of the year (such as Christmas) to make allowance for delivery delays. We will contact you immediately if there is an excessive delay with the dispatch of your Nomad & Nest Products.

Products Out of Stock –
U.K delivery – up to 14 working days
International delivery –  21 working days (subject to final destination, country and Customs clearance where Nomad & Nest will not be responsible for any delays whatsoever).

If a Nomad & Nest Product is out of stock when you place your order we will confirm an estimated dispatch date. As many of our products are handmade, out of stock Products will take longer to dispatch and deliver to you.

ORDER CANCELLATION
We appreciate that you may change your mind about ordering our Products. You have the right to cancel your order at any time before you receive the products you ordered, by emailing post@nomadandnest.co.uk typing ‘Cancellation of My Order' in the subject header.

If your order has already been assigned or dispatched when you contact us, you may return the Products within 14 working days of receipt of delivery at your own cost to receive a full refund.  If you require a refund on a discounted Nomad & Nest Product, please note that you will be refunded the discounted price. You must take care of the Nomad & Nest Product while it is in your possession and all Products must be returned in perfect unused condition with their original packaging and labels.

If you do not return the Nomad & Nest Product in the acceptable condition to us within 14 days, then you will be responsible for payment of the price of the Nomad & Nest Product. Products returned outside that period will only be refunded if the return has been authorised by our Customer Service Team. Please note that your statutory rights are not affected.

RETURNS
We operate a fair and generous 14 working day Returns Policy which is greater than the standard 7 working day Cooling Off Period that applies by U.K law to all online purchases.  Please note that a working day refers to any day except Saturday, Sunday and UK public holidays. 

When you receive your Nomad & Nest Product and you wish to return it for whatever reason you must post the Products to our address below in perfect unused condition with all their original packaging and labels to our Cardiff address. Please make sure you fill in our Returns form telling us why you are returning your Products.

Please note you will need to pay for return postage and retain the proof of posting from your shipper. We recommend you send your goods by registered post as we cannot be held responsible for any item returned to us in any other way. In the exceptional circumstances that your Product is found to be faulty we will refund the return postage once we have received the goods.

Faults - We pay particular attention to the design, finish and quality of our Products at all times. If we consider that the product is faulty we will remedy the problem in the first instance or offer a full refund if the problem cannot be remedied in any way and in this instance you will not be charged for the return delivery. If the returned item is found not to be faulty, the items will be returned to you without refund and you will incur the return postage or collection/delivery costs. Your Products will not be returned to you until any additional charges have been paid by you. If you have any questions about Returns please contact our Customer Services Team on

Exceptions - All sale Products including Rummage Products purchased can only be exchanged or refunded within 7 working days of receipt.

REFUNDS
In line with our returns policy above we offer a full refund on all online purchases with refunds being made to your credit or debit card.

We do not refund any return postage charges or accept liability for any Products until the Products have been returned, inspected by Nomad & Nest and confirmed as faulty.

EXCHANGES
If your Product is being exchanged, it will be dispatched as follows as long as we are satisfied with the condition the order is returned to us. We cannot guarantee that the replacement product will be in stock. Lead times are as follows:

Products in Stock –
U.K delivery -  within 2 - 5 working days
International delivery -  14 working days (subject to final destination, country and Customs clearance where Nomad & Nest will not be responsible for any delays whatsoever).

Products Out of Stock –
U.K delivery – up to 14 working days
International delivery –  21 working days (subject to final destination, country and Customs clearance where Nomad & Nest will not be responsible for any delays whatsoever).

If we are out of stock of your replacement order we will let you know straight away and give you an estimated dispatch date.

Exchanged Products will be sent out free of charge for the first exchange only.  Subsequent exchanges will be charged at our standard delivery rate.

Parcels will be dispatched as outlined under section DELIVERY in the Terms of this Agreement.

You must post the Products to our address below in perfect unused condition with all their original packaging and labels to our address below. Please make sure you fill in our Returns form telling us why you are returning your Products.

PAYMENTS
Payments are processed at the time of ordering. Please note that we carry out all checks and we only process orders that have been screened, validated and accepted by WorldPay. We are unable to deliver to some countries. Details of countries and cards accepted by WorldPay, can be found at www.worldpay.com

Credit and Debit Card Payments
All credit/debit cardholders are subject to validation checks and authorisation by the card issuer.  If the card issuer does not authorise payment, we will not under any circumstances process the order. 

Should your order be flagged by a 'warning' or 'caution' from WorldPay, we will contact you as soon as possible for further information required.  We require that this information be provided to us within 5 working days. If we do not receive the information in 5 working days we will cancel your order and you will be refunded via WorldPay accordingly.

Billing and Delivery Address
When entering address details, please be aware there is a difference between the billing address and delivery address sections of the order form. If your billing address (where your bank or credit card is registered to) is different from the desired delivery address, you must tick the box at the bottom of that page, and then continue to fill out the details of your billing address.

Legal Ownership of Products
Nomad & Nest will retain the legal ownership of the Products and goods until you have made payment in full and we have received cleared payment. Legal ownership of the Products will immediately reverts to us at the point we refund any such payment to you.

Any risk in the Products and goods will pass to you immediately on delivery to you.

‘Your Account’ Details
Unauthorised Use - By using the Nomad & Nest Site and purchasing through ‘Your Account’ in our Online Store, you agree to keep your password and account details confidential at all times.  You should ensure reasonable measures to prevent unauthorised access to your account without exception. You should contact us immediately in the event that you have any reason to suspect or believe that your password has become known to somebody else, or that it could be used in any way that is unauthorised by you.

Password - If you happen to forget your password you should email your request to post@nomadandnest.co.uk typing ‘Account Password’ in the Subject heading. We will reset your Password upon receipt of your email request and send it to the email address you registered with.

Please note that all Personal Information that you provide will be held in accordance with our Privacy Policy in this Agreement and Data Protection.

You are responsible for all actions that occur in relation to your account at all times.

Prices, VAT , Tax and other Duties
Within the European Union all prices of Nomad & Nest Products include U.K Value Added Tax (‘VAT”) at the current rate.  If your order is being delivered outside of the European Union Nomad & Nest will not charge you VAT but you will be required to pay your country’s Custom fees and duties.  You, as the purchaser, are responsible and liable for any other taxes, levies or duties (such as import duties) payable on Nomad & Nest Products at any foreign port, not us. Unfortunately we do not accept cancellation of orders on the basis of any unforeseen taxes, levies or duties.

MADE TO ORDER UPHOLSTERY – U.K ONLY

Stock
All Nomad & Nest upholstery is ‘Made to Order’ therefore we do not hold any upholstery in stock.

Certificate of Authenticity – Every ‘Made to Order Upholstery’ Product will arrive with a Certificate of Authenticity dated and signed and will be given personal serial number and stamped with the Nomad & Nest ‘Tattoo For Life’ as proof of originality.  As the Custodian of the Product you should keep the Certificate of Authenticity with your original Nomad & Nest invoice safe.  Together this is proof of originality and that the Product is a genuine Nomad & Nest Product.

Ordering
Orders for our Made to Order Upholstery Products are taken by our Sales Team by phoning +44 (0) 29 2022 4365.  We will email or post a full quotation that will include delivery charges to the postcode given by you together with our delivery access guidelines and your order form for you to complete and return along with your preferred method of payment and your deposit to our Sales Team.

When we receive your order and your Deposit payment has been authorised or your cheque payment has cleared our Bank Account we will send you the Order Confirmation which we require you to check fully, sign, date and return to Nomad & Nest prior to us processing your order further and before we produce your Made to Order Product.

Deposit and Payment
We require that a 50% payment (your Deposit) be made at the point of placing the order with our Sales Team.  This ‘Deposit’ is non-fundable.  We require the balance to be paid 6 working days prior to the dispatch of your Made to Order Upholstery.

We accept Credit Card Payments on Made to Order Upholstery. We also accept Cheque Payments where your order will only be accepted and processed once the Cheque received by us shows as cleared funds in our Bank Account.  This will be dependent on the individual Banks processing procedures and time and therefore delays may occur outside of our control.  

Delivery
Our Delivery Lead time for ‘Made to Order Upholstery’ is 6 to 8 weeks from receipt of your signed Order Confirmation and is also subject to the availability of materials.

These Products require a specialised delivery service and the delivery charges are dependant on geographical areas. Our Sales Team will provide you with a quote prior to you placing your order.

You will be given an approximate delivery date at the time of placing your order.  Once your Product is in production we will contact you arrange a delivery date with you prior to dispatch.

We deliver Monday to Fridays only at a pre-arranged date and time slot. We are not able to deliver on Saturdays, Sundays or any U.K Public holidays.

‘Goes Green’ Courier Service
As part of Nomad & Nests environmental commitment we offer our ‘Goes Green’ eco courier service on selected Products.  This is our dedicated, packaging-free, lower impact door to door delivery service. Please contact shopkeeper@nomadandnest.co.uk

Delivery Access
Delivery is to Ground floor and/or easy to access areas only and is at the discretion of our Delivery Team and an assessment will be made on the grounds of Health and Safety.

It is your responsibility as the customer to check accessibility for delivery of your upholstered Product.  You must ensure you check all dimensions of doorways and access routes prior to placing your order. This includes all external and all internal access routes, including gardens, doors, corridors, stairs, lifts and any other applicable access routes.

It is your responsibility to check all furniture dimensions allowing an extra 5cm to 10 cm all the way round to ensure furniture can easily be carried to the destination and where necessary can be tipped on its side or end to negotiate awkward corners.

Our Delivery Team will not force any Products and they retain the right to refuse to deliver if access is obstructed or inaccessible in any way or deemed unsafe.

Prior to placing your order you agree to read Nomad & Nests Furniture Delivery Access Guidelines that is part of your order form.

Returns
We do not accept returns on any Made to Order Products unless they are faulty or we have not followed your specification clearly detailed in your Order and our Order Confirmation that you have returned signed and dated.

Nomad & Nest Definition of a ‘Fault’ or ‘Faulty’
Our definition of a ‘Fault’ or ‘Faulty’ is: Any furniture Product or component manufactured or supplied by Nomad & Nest that become defective as a result of substandard materials or poor workmanship under conditions of normal wear and tear.
Exclusions
Any damage as a result of being marked or scratched by either a sharp object or the use of abrasive or chemical agents.
Any deterioration resulting from fair wear and tear.
Any deterioration resulting from dampness and excessive temperatures.
Any damage as a result of spillages.
Any accidental damage, abuse and misuse.
Failure to adhere to recommended cleaning and maintenance instructions.

In the unlikely event that you believe your Made to Order Product to be faulty you must notify Nomad & Nests Customer Services Team immediately with proof of purchase.

Our Customer Services Team will record your Fault Query and arrange for a Technician to visit and inspect the Nomad & Nest Product at your convenience.  Following the Technicians inspection they will record a Faulty or a Non-faulty Product and recommend a course of action direct to the Nomad & Nest Customer Services Team.  Nomad & Nest will send you a written report which will state which party is responsible for the repair and where necessary all costs will be outlined and agreed before proceeding further and prior to any remedial work being undertaken.

Fault Queries are dealt with as follows:   

Faulty Products - If we consider that the Product is faulty we will rectify and remedy the problem in the first instance or offer a full refund if the problem cannot be remedied in any way and in this instance you will not be charged for the collection and return delivery.

Non-faulty Products – If the returned Product is found not to be faulty, the items will be returned to you without refund and you will incur the full and actual costs of a collection and re-delivery which in all cases will be a higher rate than our standard delivery charge on your original order which is a special reduced rate at the time of your order.  A quote will be provided when the Product is deemed not to be faulty. 

Cancelled Orders
We are not able to refund ‘Deposits’ relating to any cancelled ‘Made to Order’ orders once we have received your signed and dated Order Confirmation form.

Due to the bespoke nature of these products we would not be able to resell items made to your specification.

Exchanges
We are not able to exchange a ‘Made to Order Upholstery’. Please refer to ‘Made to Order Upholstery’ Returns section above.

Nomad & Nest and other Nomad & Nest owned names, phrases and or logos contained in this Site are the intellectual property of Nomad & Nest Ltd. Other names on this site may be trademarks or registered trademarks of their respective owners.

Some examples include web hosting companies, credit/debit card validation and authorisation agencies, delivery and courier companies, Nomad & Nests manufacturers and key suppliers relevant to specific orders (mainly ‘Made to Order Upholstery’), customer support agencies and companies responsible for the coordination of Nomad & Nest mailings. Such third parties may be provided with access to your Personal Information if needed to perform their functions efficiently and in full, however, they may not use such information for any other purpose. Such third parties may be located in countries both inside and outside the European Economic Area ("EEA"). Nomad & Nest is committed to ensuring your Personal information is protected at all times and although countries outside the EEA may not require the same level of Personal Information protection as countries within the EEA, Nomad & Nest demands that third parties adhere to our Privacy Policy.

LIABILITY
Nomad & Nest warrants that Nomad & Nest Products will be designed and made to our standards and specification with reasonable care and skill. However, due to the nature of our Products and business we cannot and do not guarantee that Nomad & Nest Products will meet your requirements.

Nothing in this Agreement shall exclude or restrict Nomad & Nests liability for personal injury or death as a result of our negligence.

THIS AGREEMENT
Nomad & Nest is committed to conducting its business in a reasonable and fair way.  This Agreement is a contract that you have agreed to enter in to with Nomad & Nest at the time you use our Site and/or purchase our Products and replaces all earlier Agreements with you relating to the Nomad & Nest Products and Site with the exception of any fraud or fraudulent representation by you or us.

This Agreement is non-transferable. Any persons not party to this Agreement will have no rights under the Contracts (Rights of Third Parties) Act 1999 and therefore will not be able to rely on or enforce the Terms of this Agreement at any time.

AMENDMENTS TO THIS AGREEMENT
We reserve the right to change this Agreement from time to time. If we change our Privacy Policy, we will post these changes to our Site so Users and Customers are aware of our up to date Terms that will have immediate effect at the point of posting changes to the Site.

KEEPING A COPY OF THIS  AGREEMENT SAFE
We do not separately file or keep a hard copy of the individual Agreements entered into by Users or Customers of the Nomad & Nest Site. Please ensure you make a durable hard copy of this Agreement by printing and/or saving a copy on your own computer or other hard drive or storage device.

INVALIDITY
In the event that any Term of this Agreement is held to be invalid or unenforceable, the remainder of this Agreement shall remain valid and enforceable.

LAW
This Agreement, and each purchase of a Nomad & Nest Product, is governed by the laws of England and Wales and subject to the non-exclusive jurisdiction of the English Courts.
